Terms of Service

1. Acceptance of Terms

By accessing and using BeatPull ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BeatPull is an online marketplace for purchasing and licensing instrumental beats ("Beats"). Beats are created and owned by BeatPull ("Producer"). The Service allows users to preview, purchase licenses for, and download Beats.

3. User Accounts

To access certain features (downloads, purchases, favorites), you must create an account via Google OAuth. You are responsible for maintaining the security of your account.

4. Beat Licensing

When you purchase a Beat, you purchase a license to use it, not ownership of the Beat itself. License types include:

Free Tagged MP3: You may download tagged versions for personal, non-commercial use. Credit to the Producer is required. Commercial use requires purchasing a paid license.

MP3 Lease: Non-exclusive license for up to 5,000 streams. Must credit Producer.

WAV Lease: Non-exclusive license for up to 50,000 streams. Must credit Producer.

Stems License: Non-exclusive license for up to 500,000 streams. Includes stem files. Must credit Producer.

Exclusive Rights: Exclusive license. Beat will be removed from the marketplace after purchase. Producer retains publishing rights as specified in the license agreement.

5. Publishing and Royalties

For all licenses, the Producer retains 50% of the writer's share and 100% of the publisher's share of publishing royalties. The buyer receives the remaining writer's share. By purchasing a Beat, you agree to credit Anatolii Kovbasiuk (ASCAP) as co-writer when distributing any song created with the Beat.

6. Payments and Refunds

All payments are processed via PayPal. Digital products are non-refundable once downloaded. Account balance top-ups are non-refundable.

7. Beat Packs

Pack purchases include multiple Beat licenses at a discounted rate. Each Beat in a pack is individually licensed under the applicable license type specified at purchase.

8. Referral Program

Users may earn account credits by referring new users. Credits are non-transferable and can only be used for Beat purchases on the Service. BeatPull reserves the right to modify or terminate the referral program at any time.

9. Prohibited Use

You may not: redistribute Beats as standalone files; claim ownership of the Beat composition; use Beats in hate speech, illegal content, or content that infringes on others' rights; resell or sublicense the Beat.

10. Intellectual Property

All Beats, artwork, and content on the Service are the intellectual property of BeatPull. The underlying musical composition copyright remains with the Producer.

11. Termination

BeatPull reserves the right to terminate any account that violates these Terms.

12. Limitation of Liability

The Service is provided "as is" without warranty. BeatPull is not liable for any indirect, incidental, or consequential damages.

13. Governing Law

These Terms are governed by the laws of the Republic of Poland.
